1. Purpose of This Notice#

This Trademark Notice explains the ownership, proper use, and protection of the trademarks, service marks, trade names, logos, product names, design marks, brand assets, and related identifiers associated with Ackaia CipherDrive™.

CipherDrive™ is a privacy-first encrypted file drive product provided by Ackaia Corporation. The CipherDrive™ name, brand, interface identity, logos, visual identifiers, and related marks are valuable assets of Ackaia and are used to identify the source, quality, security posture, and reputation of the Platform.

This Notice is intended to help users, customers, developers, partners, press, reviewers, researchers, and the public understand how Ackaia’s marks may and may not be referenced.

2. Ackaia Marks#

For purposes of this Notice, “Ackaia Marks” means any trademark, service mark, trade name, logo, product name, icon, badge, slogan, visual identity, brand element, or other source identifier owned, claimed, used, or controlled by Ackaia Corporation.

Ackaia Marks include, without limitation:

• Ackaia;

• Ackaia Corp.;

• Ackaia Corporation;

• CipherDrive™;

• Ackaia CipherDrive™;

• any CipherDrive™ logo, icon, wordmark, interface mark, product badge, or visual identifier;

• any Ackaia logo, company mark, product family mark, or related brand asset;

• any future marks, names, slogans, icons, or product identifiers associated with CipherDrive™ or other Ackaia products.

The absence of a mark from this Notice does not constitute a waiver of any intellectual property right, trademark right, service mark right, trade name right, brand right, or other legal right held by Ackaia.

3. Ownership of CipherDrive™#

CipherDrive™ is a trademark or service mark of Ackaia Corporation. Ackaia owns or claims rights in the CipherDrive™ name and related brand identifiers as used in connection with encrypted file storage, privacy-first cloud services, security software, client-side encryption systems, account interfaces, file sharing features, related websites, documentation, and associated services.

Use of the “™” symbol indicates Ackaia’s claim of trademark rights in CipherDrive™. The mark may be registered, pending registration, or unregistered in one or more jurisdictions. Trademark rights may arise through use, registration, pending applications, or applicable law.

Nothing in this Notice grants any ownership interest in CipherDrive™, Ackaia, Ackaia Corp., or any other Ackaia Marks.

4. No License Granted#

This Notice does not grant you a license, permission, authorization, or other right to use any Ackaia Marks except as expressly stated in this Notice or in a separate written agreement signed or approved by Ackaia.

You may not use Ackaia Marks in a way that suggests sponsorship, endorsement, partnership, certification, affiliation, approval, or official status unless Ackaia has expressly authorized such use in writing.

You may not register, claim, apply for, purchase, reserve, or use any trademark, trade name, company name, domain name, social media handle, product name, app name, repository name, package name, keyword, advertising term, or other identifier that is identical or confusingly similar to any Ackaia Mark.

5. Permitted Reference Use#

You may make truthful, accurate, and non-misleading references to CipherDrive™ for purposes such as:

• identifying CipherDrive™ as an Ackaia product;

• discussing, reviewing, comparing, or commenting on CipherDrive™;

• describing compatibility, integration, documentation, tutorials, or security research;

• referencing Ackaia as the provider of CipherDrive™;

• linking to official Ackaia or CipherDrive™ resources;

• reporting news, analysis, reviews, or educational commentary.

Any permitted reference must be fair, limited, accurate, and not likely to confuse users about your relationship with Ackaia.

When referencing the product for the first time in a document, article, page, repository, publication, or similar material, use the full product name where practical:

Ackaia CipherDrive™

After the first reference, CipherDrive™ may be used.

6. Proper Trademark Attribution#

Where practical, public materials that reference CipherDrive™ should include an attribution notice substantially similar to the following:

CipherDrive™ is a trademark of Ackaia Corporation.

For broader references to Ackaia brand assets, an attribution notice may state:

Ackaia, Ackaia Corp., and CipherDrive™ are trademarks, service marks, or trade names of Ackaia Corporation.

Attribution does not create permission to use the marks in a prohibited or misleading manner.

7. Prohibited Uses#

You may not use Ackaia Marks in any manner that:

• implies that Ackaia sponsors, endorses, approves, certifies, or is affiliated with you, your product, your service, your company, your content, or your project without written permission;

• suggests that your product or service is an official Ackaia product, official CipherDrive™ client, official CipherDrive™ integration, or official Ackaia distribution when it is not;

• is likely to confuse users about the source, origin, ownership, sponsorship, or control of a product, service, website, repository, application, package, plugin, integration, or publication;

• modifies, distorts, abbreviates, mistranslates, stylizes, pluralizes, combines, or alters the CipherDrive™ mark in a way that weakens, damages, or misrepresents the mark;

• uses the CipherDrive™ mark as a noun, verb, generic term, or category name rather than as a product identifier;

• uses Ackaia Marks in connection with illegal, abusive, deceptive, fraudulent, infringing, exploitative, harmful, or prohibited content or conduct;

• disparages, dilutes, tarnishes, or damages the reputation, distinctiveness, goodwill, or value of Ackaia Marks;

• appears in a domain name, subdomain, app name, social media handle, package name, repository name, product name, company name, or advertising keyword in a confusing or misleading way;

• copies or imitates Ackaia’s trade dress, interface identity, product presentation, visual hierarchy, iconography, website layout, or brand style in a way that creates confusion;

• uses any Ackaia logo, icon, product badge, or design asset without written authorization or an applicable brand-permission policy published by Ackaia.

8. Logos, Icons, and Brand Assets#

Ackaia logos, CipherDrive™ logos, product icons, badges, design marks, screenshots, interface assets, and other visual brand assets may be protected by trademark, copyright, trade dress, and other laws.

Unless Ackaia provides a written license, brand policy, press kit, partner agreement, or other express permission, you may not use Ackaia logos, CipherDrive™ logos, icons, badges, or design assets.

If Ackaia publishes official brand assets for press, partnership, review, documentation, or developer use, you must follow the applicable usage guidelines, including any requirements related to size, spacing, color, contrast, placement, attribution, modification, and context.

You may not alter, recolor, distort, animate, combine, frame, or overlay Ackaia logos or CipherDrive™ brand assets in a way that misrepresents the brand or creates confusion.

9. Product Names, Integrations, and Compatibility Statements#

Developers, vendors, reviewers, researchers, and third parties may describe truthful compatibility with CipherDrive™ using accurate wording, such as:

• “compatible with CipherDrive™”;

• “for use with CipherDrive™”;

• “integration for CipherDrive™”;

• “works with CipherDrive™”;

• “security review of CipherDrive™”.

However, you may not use names such as:

• “Official CipherDrive™”;

• “Ackaia CipherDrive™ Pro”;

• “CipherDrive™ Cloud”;

• “CipherDrive™ Client”;

• “CipherDrive™ Security Suite”;

• any similar name that suggests official origin, sponsorship, endorsement, or ownership by Ackaia,

unless Ackaia has expressly authorized the use in writing.

A third-party integration, plugin, client, SDK, tool, script, review, or documentation project must make clear that it is independent if it is not created, maintained, or approved by Ackaia.

10. Domains, Handles, Advertising, and Search Keywords#

You may not register or use domains, subdomains, usernames, social media handles, repository names, package names, paid search keywords, advertising copy, app-store listings, marketplace listings, or other identifiers that contain or imitate Ackaia Marks in a way that may confuse users.

Examples of potentially misleading uses include names that suggest official status, such as “cipherdrive-support”, “ackaia-cipherdrive-login”, “official-cipherdrive”, “cipherdrive-security”, or similar identifiers, unless approved by Ackaia.

You may not use Ackaia Marks in phishing pages, fake login pages, impersonation campaigns, misleading advertisements, counterfeit services, unauthorized support services, or deceptive search placements.

11. Open Source, Source-Available Code, and Community References#

Ackaia may publish certain code, documentation, cryptographic materials, protocol explanations, or related repositories under source-available or other licenses. Publication of code or documentation does not grant trademark rights.

A software license may grant rights to inspect, use, copy, modify, or distribute certain code only as stated in that license. It does not grant the right to use Ackaia Marks as the name of a derivative product, competing service, hosted service, commercial distribution, modified version, or public-facing brand.

If you fork, reference, review, audit, or discuss Ackaia source-available materials, you must avoid suggesting that your version is official, endorsed, maintained, certified, or approved by Ackaia unless Ackaia has expressly authorized that representation.

12. Press, Reviews, Commentary, and Screenshots#

Members of the press, reviewers, educators, researchers, and commentators may refer to CipherDrive™ and Ackaia for truthful reporting, criticism, commentary, education, or analysis.

Screenshots of CipherDrive™ may be used for accurate commentary, review, documentation, or reporting where such use is lawful, limited, and non-misleading. Screenshots must not expose private user data, confidential information, credentials, security tokens, encryption keys, internal systems, or non-public materials.

Ackaia may request removal or correction of materials that misuse Ackaia Marks, misrepresent the Platform, create user confusion, expose sensitive information, or violate applicable law.

13. Third-Party Marks#

All third-party trademarks, service marks, logos, product names, company names, and brand identifiers referenced by Ackaia or in relation to CipherDrive™ are the property of their respective owners.

Reference to third-party marks does not imply endorsement, sponsorship, affiliation, partnership, certification, or approval by those owners unless expressly stated.

Ackaia’s use of third-party marks is intended for identification, interoperability, commentary, comparison, documentation, or descriptive purposes where applicable.

14. Enforcement and Reservation of Rights#

Ackaia reserves all rights not expressly granted in this Notice. Ackaia may take action against unauthorized, misleading, infringing, dilutive, deceptive, abusive, or harmful uses of Ackaia Marks.

Enforcement actions may include requesting correction, requesting attribution, requesting removal, disabling access to Ackaia services, suspending accounts, reporting impersonation or phishing, submitting takedown requests, contacting registrars or platforms, pursuing legal remedies, or taking other appropriate action.

Failure by Ackaia to object to a particular use of a mark does not constitute approval, waiver, consent, or loss of rights.

15. Changes to This Notice#

Ackaia may update this Trademark Notice from time to time to reflect new products, marks, brand assets, legal requirements, business changes, enforcement practices, or product changes.

Updated versions may be published through Ackaia websites, legal repositories, product documentation, account notices, or other reasonable channels. Continued use of Ackaia Marks after an update means you are responsible for following the updated Notice.
